EMUE Script Library Terms and Conditions

By downloading any OLIE and/or EMUE scripts and related materials (collectively referred to hereafter as “Script” or “Scripts”) from this website, you acknowledge and agree to the following:

  • The content of the Scripts has been submitted by users in the Siemens Medical Health Services Corporation (hereafter referred to as “Siemens”) SIGNATURE® or INVISION® user community and has not been endorsed, recommended, verified, or otherwise approved by Databound Healthcare Solutions, Inc. (hereafter referred to as “Databound”) nor Siemens.
  • The content of the Scripts has been submitted by users in the Siemens Medical Health Services Corporation (hereafter referred to as “Siemens”) SIGNATURE® or INVISION® user community and has not been endorsed, recommended, verified, or otherwise approved by Databound Healthcare Solutions, Inc. (hereafter referred to as “Databound”) nor Siemens.
  • The Scripts have been submitted to this website with the intent of making them available to Siemens SIGNATURE or INVISION customers for their internal use only. This means that
    • You and all other users of this website can download Scripts for your internal reference use only.
    • You assume all risks regarding the determination of whether or not a Script is appropriate for your particular needs.
  • Neither Databound nor Siemens has tested the Scripts to verify their appropriateness for their claimed function, nor have either party verified that the Scripts do not contain instructions written with malicious intent. As a result, you should take special precautions before using the Scripts including, but not limited to:
    • A visual inspection of the code
    • Thoroughly testing the Scripts in your application test region before using in production.
    • Stepping through the Scripts with the EMUE debugging tools and/or using HLLAPI trace files to insure safe, proper, and intended operation.

By submitting this OLIE and/or EMUE Script and related materials (collectively referred to hereafter as “Submission”), you represent that the Submission is your own material (subject to rights Siemens has in the scripts as “derivative” (within the meaning of the United States Copyright Code (Title 17, United States Code §§101 et seq.), is otherwise free of copyright or other restrictions by yourself or any third party, and do not contain instructions written with malicious intent. Furthermore, you agree that the Submission and all of its contents are being submitted for the purposes of being shared with the Siemens user community and are hereby being submitted to the Databound listserv for such use.. Neither Databound nor Siemens is responsible for monitoring or managing the content of your Submission or any Submission of other parties.

UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY WHETHER IN TORT, CONTRACT, EQUITY OR OTHERWISE SHALL DATABOUND, SIEMENS AND THEIR RESPECTIVE LICENSORS, DISTRIBUTORS, DEALERS, SUPPLIERS, INVESTORS, EMPLOYEES, OR DIRECTORS BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION OR ANY AND ALL OTHER COMMERCIAL DAMAGES OR LOSSES EVEN IF DATABOUND OR SIEMENS SHALL HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES OR FOR ANY CLAIM BY ANY OTHER PARTY. FURTHER, IN NO EVENT SHALL DATABOUND’S OR SIEMENS’ LIABILITY UNDER ANY PROVISION OF THIS AGREEMENT EXCEED $100.00. BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
